1Acceptance of terms

By downloading, installing or using the Game, you agree to be bound by these terms and conditions. If you do not agree to these terms, please do not download, install or use the Game.

2License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes on devices owned or controlled by you, subject to these terms.

3User conduct

When using the Game, you agree not to:

• Use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software
• Disrupt or interfere with the experience of other users
• Attempt to access areas of the Game or Game servers that you are not authorized to access
• Use the Game for any illegal purpose, or in violation of any local, state, national or international law
• Harass, abuse or harm another person, or use the Game to contact, advertise to, solicit or sell to other users

4User content

If the Game allows you to create, upload or share content:

• You retain all rights to your content, but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate and distribute your content in connection with the Game
• You are solely responsible for your content and the consequences of posting or publishing it

We reserve the right to remove any content that violates these terms or that we find objectionable.

5Intellectual property

All rights, title and interest in and to the Game, including but not limited to software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, audio, video, music and all intellectual property rights, are owned by us or our licensors.

6In-app purchases

Some of our games offer optional in-app purchases. Purchases are processed by the store you downloaded the Game from, either Google Play Billing or Amazon In-App Purchasing, and are subject to that store's own terms and refund policies. We do not receive or store your payment card details.

Virtual items and currency have no monetary value outside the Game, cannot be exchanged for cash, and may be removed if the Game is discontinued.

7Disclaimer of warranties

THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9Updates to these terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new terms on this page or through the Game. Changes will be effective immediately upon posting.

10Termination

We may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms.

This policy explains how Yipjoy collects, uses and protects information when you use our mobile games and applications, including Cubely, Gooey: Virtual Pet & Mini Games, and Kids Coloring Book. By using our games, you agree to the practices described here.

Information we collect

Our games are designed to be safe and family-friendly. We do not require users to create an account, or to provide their name, email address, phone number or other directly identifying personal information to play the game.

We do not knowingly collect personal information directly from children.

Third-party services

Our games may use third-party services that collect information according to their own privacy policies. These services may include Google Play Services, Google Play Billing, Google AdMob, Amazon Appstore and Amazon In-App Purchasing, Unity Services and Adjust.

Advertising

Some of our games may show ads. Ads may be provided by third-party advertising networks such as Google AdMob or other ad partners. These partners may collect and use information such as device identifiers, advertising identifiers, approximate location and app usage data to show ads and measure ad performance. Where required, we use settings designed for child-directed or family-friendly apps. Users may be able to control personalized ads through their device settings or Google account settings.

In-app purchases

Our games may offer optional in-app purchases. All purchases are processed securely by Google Play Billing or Amazon In-App Purchasing. We do not receive or store your payment card details. The store may provide us with purchase confirmation information, such as the purchased item, transaction status and receipt data, so that we can unlock the purchased content inside the game.

We may share limited information with third-party service providers only when necessary to operate the game, show ads, analyze app performance, detect crashes and errors, process purchases, comply with legal obligations, and protect the safety and security of users and our services.
